· Here and there:
· 1) ICC Prosecutor Luis Moreno-Ocampo has been given the green light to respond collectively to applications for leave to appeal filed by the 4 accused Kenyans Uhuru Kenyatta, William Ruto, Francis Muthaura and Joshua Sang. Judge Ekaterina Trendafilova on Wednesday said the prosecutor could present two documents instead of four challenging the applications made by the 4 accused over the confirmation of charges against them.
· The judge also allowed the prosecutor to file up to 40 pages of each document. ICC regulations provide that a document filed with the court’s registry should not exceed 20 pages, unless otherwise provided in the Rome Statute or ordered by the Chamber. Judge Trendafilova said in her ruling (on 2nd February, 2012): “The Single Judge is of the view that the choice of whether to file a consolidated response, to the defence applications, ultimately rests with the prosecutor and, therefore, that no leave is necessary to this effect.”
· In his request on Monday, Moreno-Ocampo argued that the defence applications contain common issues that he believed could be addressed in a single consolidated response. We wish our Kenyan brothers all the best; and pray that the Chamber is not trying to be clever by half! For instance, Moreno-Ocampo was quoted (Standard, 30th January, 2012) to have commented on 24th January, 2012 that: “The appeal process will delay trial, some people will be disappointed but we respect their right to appeal.”
· 2) ICC spokesman Fadi el Abdallah was quoted saying (3rd February, 2012) that the ICC is “closely monitoring the Kenyatta-Ruto led peace-cum-prayer meetings for any hate speech and/or inflammatory utterances.”
· We have already mentioned the role of the civil society mercenaries and that there is a serious conspiracy of evil trying to ensure that the appeals are frustrated; that Kenyatta and Ruto are completely gagged and/or even arrested. Abdallah’s statement must fall under this category.
· But who is this Abdallah fellow to address Kenya and Kenyans as if we are one big kindergarten; does he have any tinge of respect for Kenyan traditions, customs and culture; does he not know that the peace-cum-prayer meetings are attended by serious, mature and responsible Kenyans including community elders and religious leaders;
· Who said we must be monitored like small children and why is Abdallah, and his colleagues (at the ICC), never bothered with areas like the Gaza Strip, et cetera, where the Israelis are for ever slaughtering Palestinians like wild animals and issuing war ultimatums to Iran; and who is using Abdallah (at the international level because we know the internal culprits) to provoke Kenyans, and particularly Kenyatta and Ruto?
· This Abdallah fellow has all the characteristics of our shameless mercenaries; but if he has nothing to say or do to justify his salary he should just leave Kenyans alone! Making nonsensical statements, issuing meaningless and unhelpful threats, exhibiting raw and tasteless contempt and arrogance, and generally treating Kenyans (collectively) like primitive slaves is totally unacceptable. Abdallah should behave himself and always weigh his words.
· He reminds us of Comrade Robert Mugabe’s description of US diplomat Jonnie Carson, in 2009, in Tripoli, Libya: “He is an idiot with a condescending attitude!”
· 3) Are there some leaders trying to use dangerous diversionary tactics to ease mounting political pressure on themselves and their party or parties; leaders trying to create artificial insecurities/”accidents” all over the country; is this strategy in any way related to the ICC process, the appeals by the 4 accused Kenyans and/or the obvious attempts to gag them (the 4 accused Kenyans);
· Does the threat, to strike by teachers and doctors, fall under this general strategy; and who is sponsoring press conferences by moral urchins the likes of Ndura Waruingi; what is the role of Prof. Nyong’o, he of the-KShs.2, 450-Serena Hotel-daily -lunch infamy, in this general strategy; and which party stands to gain more (if at all there are any gains!) from all this? The desperados in the ODM-KPU party can be extremely reckless.
· 4) But have inflammatory and/or hate speeches been made in the peace-cum-prayer rallies? Let us listen, briefly, to a few statements as captured at the Kinoru Stadium (in all the dailies of 3rd February, especially the Standard and then kindly, please make up your mind):
· One, MP Peter Mwathi: “We should win this election in the first round and not eye a run-off. Let us not leave doubt and give people reason to divide us.”
· Two, MP Cecily Mbarire: “We want to tell them (the G7 leaders) that we are tired of being moved from one party to another. One day we are in PNU, the other one in PNU Alliance, others are in Kanu, some in URP and we are now left confused. If we go to elections with all these parties, I can assure you that we will not make it to State House. We will be in the opposition forever.”
· Three, Francis ole Kaparo: “You have heard what the people want (unity of the G7 leaders) and if you don’t join hands it will be your fault.”
· Four, Kiraitu Murungi: “I have told Uhuru with his Kanu, he is not seeing the presidency. Similarly Ruto and his URP, there is nowhere he is going and the VP with his Wiper should bid bye to State House! I am the mechanic of the bus and it is Uhuru and Kalonzo who told me to form this alliance party and if am not truthful they are here to state otherwise.”
· Five, Eugene Wamalwa: “If we remain united, I am sure that one of us will be president. We are united with a common purpose of bringing change to this country.”
· Six, Cyrus Jirongo: “I want to tell my friend Kiraitu that it is the politics of good ideals that will succeed not tribal alliances. Regional parties have no chance of winning support in the whole country (and) that is why I left Kaddu and Ruto left ODM to form a national party.”
· Seven, Kalonzo Musyoka: “Our unity is our strength and we want to avoid the politics of mudslinging. I will be in the forefront in preaching unity because I know how important it is. We must trust one another.”
· Eight, William Ruto: “We want to make it very clear to Mutula and those who have sent him that we have heard his message, but he should give us a break. Let him bring a law (Bill) in Parliament on the same or else he should shut up! There is no need to panic, because there is hope and we cannot afford to let our people down. We have all it takes to bring change in the country.”
· Nine, Uhuru Kenyatta: “There are some people who are talking about the presidential race, this and that; but why won’t they, why don’t they allow the people to decide? We are in an independent country and cannot be dictated on what to do. The people of Kenya will decide their own leaders; the people will decide their next President…
· We have heard what the people have said that without unity we are not going to get to State House. We want to plead with you to give us time to traverse the country; then we will tell you the direction we have all agreed.”

· 6) The great people of Kenya must refuse the choice of leader(s) that the Western racist neo-colonialists want to impose on them; the people of Kenya must decide on their own free will; the people of Kenya must be respected, unconditionally; their dignity as human beings must be respected, without any conditions; Kenyans are neither sub-humans nor amnesiac idiots; their human, constitutional and sovereign rights must be respected, at all times;
· Kenyans must reject leaders like the Rt. Hon. PM who, like a crybaby, is at the beck and call of his contemptuous and arrogant foreign masters on whom he is relying entirely to deliver the presidency, via The Hague process; Kenyans are not slaves and will never be colonised again!; let the people decide; Let the people decide; and kindly, please: Let the people decide! Never call it icc but ACC(africa criminal court)coz its court met for africa,why no american is prosecuted due to no iraq where many pipo die coz they thought saddam had weapon of mass destruction but they found none.is not that crime against humanity??
